Lawsuit Filed Against MSC Elsa 3 Owner and Crew in Wake of Kerala Maritime Disaster
According too a recent report from Indian authorities, a criminal case has been initiated against the owner, captain, and crew of the MSC Elsa 3, which tragically sank near Kochi last month. This incident took place on May 25, 2025, about 13 nautical miles off the coast of Kerala after the ship developed a significant starboard tilt just one day prior. The vessel was making its way from Vizhinjam to Cochin when disaster struck.
Fortunately, all 24 crew members were rescued by the Indian coast Guard shortly after the sinking. However, legal actions have been taken against those responsible under various sections of India’s justice Code for reckless navigation and negligent management of hazardous materials. The First Data Report (FIR) highlights that despite being aware of hazardous and flammable cargo onboard, those in charge operated the ship carelessly.
The aftermath has raised serious environmental concerns as containers were lost at sea and hazardous plastics were released into coastal waters. This not only threatens marine life but also disrupts local fishing activities and obstructs shipping routes. Notably alarming are 13 containers filled with Calcium Carbide—an extremely reactive substance that can produce flammable gases upon contact with water.
An investigation commenced on June 10 following orders from kerala’s Coastal Police Inspector General. Authorities are set to gather testimonies from representatives of MSC shipping as well as from the captain and crew involved in this incident.
Salvage operations are currently underway with an urgent directive issued for oil recovery within a tight timeframe before monsoon conditions complicate efforts further.
